Another friend of rape: The Department of Defense
Tuesday, October 20, 2009 at 7:08PM Wow, might we be a silent majority? I keep finding supporters everywhere I look! For instance, today I learned that the Department of Defense supports our cause. Here's an excerpt from an article on HuffPo:
The men had an ally in opposition that has so far gone unreported: the Department of Defense.
"The DoD opposes the proposed amendment," reads a message sent from the administration to the Senate on October 6, the day the amendment passed by a 68-30 vote.
"The Department of Defense, the prime contractor, and higher tier subcontractors may not be in a position to know about such things. Enforcement would be problematic, especially in cases where privity of contract does not exist between parties within the supply chain that supports a contract," reads the DoD note. "It may be more effective to seek a statutory prohibition of all such arrangements in any business transaction entered into within the jurisdiction of the United States, if these arrangements are deemed to pose an unacceptable method of recourse."
Franken's amendment is intended to address the type of Kafka-esque treatment Jamie Leigh Jones received from the U.S. justice system after she was gang-raped by fellow KBR workers. The defense contractor argued that her employment contract required that her claim be heard in private arbitration rather than in open court.
Kudos to the Department of Defense for supporting our brave band of thirty.

I spent 30 years in the Federal government and I have never seen any response this convoluted. I was not in DOD. Maybe that's why. US Forest Service people are normally expected to make rational and concise responses to higher HQ.
Oh, I just figured it out. The people at the top are there because of their proven ability to baffle with bullshit. Specifically to baffle Congress.
Until I can have my legal staff interpret this response I must withhold judgement as to whether the Pentagon is on the side of us Republicans for Rape.
They're opposing it based on the difficulty for the DoD to figure out who is forcing these clauses, rather than banning them outright. They are actually suggesting that it would be better instead to make them illegal within the United States period.

This site is disgusting. I find it hard to believe there are people who would actually stoop this low and sell their soul in order to score a cheap political point. To spread such falsehoods and attempt to dehumanize and demonize those with whom you disagree is not only cowardly, it's despicable. You WILL get your just reward, in this world or the next.
That was pretty convoluted, which is impressive considering. I can understand them saying they can't know about every case of sexual assault. Obviously that's true. Still, it's just not good enough to give that as an overall statement.
If you're not going to deal with the consequences of the cases you so clearly do know about; what makes you think anyone will believe you when you say you don't know?

I'm not sure how familiar you are with government contracting practices, but the DoD make a very strong point here. It is nearly impossible to tell what a particular company's individual contracting practices are. A better move on Franken's part would have been to, as DoD suggested, make these types of contracts illegal. Franken's move, while well-intentioned is not something which can easily be put into action.
But, if it's easier to boil everything down to a Manichean choice of Good vs Evil, please feel free to continue this modern American form of "political discourse." I'm sure you and your kissing cousins in the Tea Party movement will have a good time further cheapening the term "democracy."
I think what that means is, for instance, if the DoD contracts with company A, which subcontracts to company B, which subcontracts to Halliburton, which requires its employees to waive their rights, you shouldn't punish company A by withholding their fees, maybe not even company B, but instead Congress should invalidate the employee agreement and let them sue Halliburton notwithstanding their waiver agreement. It's not unheard of for certain waivers of rights to be held to be unenforcable by statute.
If the Supreme Court rules in Jamie's favor, it will become the law of the land. This is really intended as a slap against Halliburton and KBR in the mean time while their appeal gets decided.

It is our belief, here in TEXAS, that even if a lady has been raped, she should be forced to carry the baby to term! Anyway, now that all right thinking Americans have agreed to genuflect to Father Bill of Faux News and its demon spawn CNN/HNN, I think we can agree that what we are seeing is that those gumballs that used to think such ludicrous things are growing restive. I didn't know my first Bud, Glenn Beck had raped and murdered a girl. I guess the rape was OK, but I kinda hate he murdered her. She might have been of some use to you and me. Of course, let's be realistic; in this swamp of liberal bleeding hearts and women voters, a live victim could be a real liability, especially if she has a Dad or big brother who is real big and mean.
My sister was told to "fuck or walk" on a couple occasions, her retort typically ran to the effect that she would walk, but, "When my big brother gets back from the war I'm gonna tell him what you said, and I would not give a nickel for your chance to live 'til dawn." Curiously that seemed to take much of the strach (so to speak) out of their jeans. He was my big brother too, and while I thought he was a fine human being with few vices, I had to agree that I would not give a nickle for their chances either. Not to suggest that he would not have been a good recruit for our RFR party, merely that he had a strongly proprietary attitude about his little sister - "mess with my Chevy, I'll break your legs, mess with my little sis, I'll pull your arms off and beat you to death with 'em."

Anyone who thinks that this DoD argument and not the protection of their business friends is the real reason for the nay vote, needs to go back to school. Guns over women. What else is new? 10,000 years.
